These Terms of Service ("Terms") govern your access to and use of the Gawibawibo mobile application (the "App"), operated by Sircle Networking Pvt Ltd ("we," "us," "our"). Downloading, accessing, or using the App means you accept these Terms and our Privacy Policy — if you're not on board with that, please don't use the App.
Gawibawibo is an independent, non-commercial fan project and is not affiliated with, endorsed by, or sponsored by BTS, HYBE Corporation, or BIGHIT MUSIC. Fan references (e.g. "ARMY," "BTS mode") are used solely for non-commercial fan-tribute purposes under nominative fair use. See Section 7 for details.
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the App. If you are under the age of majority in your jurisdiction, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.
You may sign in using Google or Apple. You are responsible for maintaining the security of your account and for all activity under it. You agree to provide accurate information and to notify us of any unauthorized use of your account.
The App includes an optional "ARMY"/BTS-inspired theme, developed independently by fans as commentary, homage, and creative expression, not as a substitute for or imitation of any official product. This use is intended to fall within nominative and transformative fair use principles for fan works.
We do not claim ownership of any BTS, HYBE, or BIGHIT MUSIC trademarks, copyrights, music, images, or other intellectual property. If you are a rights holder and believe any content in the App infringes your rights, please contact us (see Section 14) and we will promptly review and address the concern, including removal of the content if warranted.
All original software, design, and content created by us for the App (excluding user-generated content and any third-party fan references) remains our property or that of our licensors.

You acknowledge and agree that Gawibawibo is an unofficial fan project. It is not produced, authorized, endorsed, or sponsored by BTS, its members, HYBE Corporation, BIGHIT MUSIC, or any of their affiliates or licensees. Any similarity in naming or theming is coincidental to the fan-tribute nature of the App and is not intended to, and should not be understood to, suggest any official relationship.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE MAKE NO WARRANTY REGARDING THE ACCURACY, RELIABILITY, OR AVAILABILITY OF ANY CONTENT, INCLUDING USER-GENERATED FAN ART OR MATCHMAKING RESULTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR DEVELOPERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF, OR INABILITY TO USE, THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS PRECEDING THE CLAIM (WHICH, FOR A FREE APP, MAY BE ZERO).
You agree to indemnify and hold harmless Sircle Networking Pvt Ltd from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the App, your user-generated content, or your violation of these Terms or any third party's rights.
We may suspend or terminate your access to the App at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users or the App. You may stop using the App and request account deletion at any time.
We may modify, suspend, or discontinue the App, or update these Terms, at any time. Material changes will be reflected by an updated "Last updated" date on this page. Continued use of the App after changes constitutes acceptance of the revised Terms. If any rights holder requests removal of fan-tribute content, we reserve the right to modify or remove such content promptly.
These Terms are governed by the laws of India, and courts in Telangana will have exclusive jurisdiction over any disputes, unless applicable local consumer protection law says otherwise.
